EDUCATIONAL USE & PUBLIC PERFORMANCE RIGHTS
Thank you for your interest in showing one of the Rare Equine Trust Films. We are proud to offer your institution or organization these titles for educational use. We offer two types of license for showing our films: the Educational Use License and the Public Performance Use License.
I. EDUCATIONAL USE LICENSE
The Educational Use License allows for Limited Performance of the film within a College, University, K-12 School, Research Institution, Grassroots Organization, or Non-Profit Organization to a classroom-sized audience of students for the lifetime of the DVD, without any admission charged.
Educational Use License – Restrictions
Audience size. The DVD purchased under this license may be exhibited to a classroom-sized audience of students.
Admission. No admission can be charged.
Advertising/Marketing/Publicity. May only be promoted to members of the purchasing organization and cannot be advertised to the public.
Venue. Must be related to the purchaser named on license.
If you plan to use your DVD with Educational Use License as part of a screening to an audience larger than a classroom-sized audience and/or will be charging admission, please contact us with details.
II. PUBLIC PERFORMANCE LICENSE
Public Performance Rights are those granted for the public display of a film to an audience outside the privacy of your home. These types of screenings are typically for onetime events, festivals, or semi-theatrical screenings. Pricing structure depends on a number of factors for different kinds of events. See below.
Public Performance Rights – Restrictions
No Admission Charge. If you are not charging admission to your screening, a flat fee of up to $350 will need to be paid in full before your screening. This fee usually includes rental of the exhibition format (DVD or Blu-ray), but excludes shipping & handling. DVD material must be returned within 10 days of screening.
With Admission Charge. If you will be charging admission to your screening, an advance guarantee of up to $350 will need to be paid first. Then, after your screening, 50% of the Total Box Office (TBO), less the advance guarantee will need to be paid to Horsefly Films. Example below.
Total Box Office (gross) $2,000.00
50% of TBO (gross): $1,000.00
Less Advance Guarantee $350.00
AMT DUE TO Horsefly Films: $650.00
Note, if 50% TBO is less than or equal to $350, then the amount due to Horsefly Films is $350.00 (the advance guarantee).
III. WHO CAN BUY A DVD WITH EDUCATIONAL USE LICENSE OR PUBLIC PERFORMANCE RIGHTS?
Any individual, institution, or organization in the world is eligible to purchase the Educational Use License or Public Performance Rights, though some special restrictions may apply.
IV. HOW MUCH DO PUBLIC PERFORMANCE RIGHTS OR EDUCATIONAL DVDS COST?
Below is the general pricing structure for the Educational Use License and Public Performance Rights. Prices may vary from film to film and may change anytime without notice. Please refer to the specific DVD page in the store for actual prices.
FEES
Educational Use License - No Admission - $150
Public Performance – No Admission - $350
Public Performance – With Admission - $350 with 50% of Total Box Office
V. WHAT IF I CAN'T AFFORD TO PAY FOR A PUBLIC SCREENING OR EDUCATIONAL DVD?
If you are a Non-Profit or hosting a fundraiser, you may be eligible for our wholesale special. For every (10) ten DVDs of a single title you purchase at our wholesale rate, we will waive the screening fee and grant your organization the Public Performance Rights for (1) one screening to which admission is not charged. You can use these DVDs as part of a fundraiser, sell at the suggested retail price to recoup your screening and event expenses, or to give away as prizes or gifts. Unless the DVDs you receive are damaged or defective there are no exchanges, returns or refunds on these. Please contact us to discuss.
VI. WHAT IS THE EXHIBITION FORMAT?
The exhibition format is DVD. If you are ordering Public Performance Rights only, then Horsefly Films will send you an Exhibition Rental DVD, which will need to be returned within (10) ten business days after your screening. If you do not return the DVD within that time, you will be charged an additional $250 per day. An additional fee may apply for screenings using a Blu-ray. Contact us for details.
VII. SHIPPING & HANDLING
For expedited shipments, please contact us directly.
* For expedited shipments, a street address must be provided. Horsefly Films cannot ship to PO Boxes.
VIII. WHAT IF MY DVD DOESN'T WORK?
You must order and receive the DVD to be tested within good time of your planned screening. Horsefly Films is not liable for any delay regarding defective DVDs. If your DVD does not work or is damaged upon receipt, Horsefly Films will be happy to send a replacement. Once we receive the damaged or defective product is received, a new one will be shipped out.
IX. ARE THERE ANY OTHER TERMS?
Payment must be received before orders can be shipped or screenings authorized.
Purchaser pays the return cost of shipping for Exhibition Rental DVDs.
Additional material will vary from film to film.
